A bit about us:
We are a newly set up charity and the result of a joint venture between Scottish Government, the University of Edinburgh and Public Health Scotland. Our work will be done in collaboration with these and other major contributors to the field of data driven research.
Our mission is to improve the economic, social and environmental wellbeing in Scotland by enabling access to and linkage of data about people, places and businesses for research in the public good.
By bringing together expertise, resources and capabilities from a range of existing data-led programmes across the public and private sectors and academia we will help researchers get access to the linkage-ready data they need to complete, potentially, life-saving or life-changing research more quickly, but without compromising on our duties regarding ethics, information governance or data security.

A bit about the job:
We are looking for a General Counsel/Legal Manager. Your focus will be on supporting the development of RDS as it establishes itself in the data landscape in Scotland. You will be the primary source of legal advice and support to the RDS joint venture and its programmes. 
You will also support the development of Information Governance for RDS by ensuring that data access processes through RDS are streamlined and proportionate while being legally robust and compliant at all times.  You will collaborate with the Scottish Government (SG) Legal Directorate, externally contracted solicitors, where appropriate, and solicitors from other partner organisations. You will also work with the RDS Data Protection Officer and support colleagues across the organisation.
There will be a strong focus on project management and stakeholder engagement, often at senior level.

Role: General Counsel/Legal Manager (Solicitor)
Pay: C2 - £50,000 - £59,000. Generally people start at the first point on the scale, but for roles with specialist skills and where there are recognised recruitment difficulties a level of flexibility will be considered.
Hours: 35 per week    
Employment Type: Permanent. Happy to discuss a 2-year secondment from similarly minded organisations providing you have prior agreement from your department director or line manager.

Key Duties and responsibilities will include:

  • Providing legal advice and support RDS business and its programmes on all legal aspects
  • Providing general corporate/commercial and commercial contract advice
  • Identification and research as well as evaluation of legal risks impacting on RDS business decisions and operations for the CEO, the Board and senior management
  • Responsibility for drafting and negotiating a wide range of bespoke agreements, including commercial contracts, consultancy agreements, data sharing and processing agreements and other agreements as required
  • Involvement and, where relevant, responsibility for corporate contracting, financing and other key elements of RDS business
  • Ensuring governance and compliance with all regulatory aspects supporting the CEO, Board and senior management
  • Supporting the development of the Information Governance Framework for RDS. This will require working with partners and stakeholders to ensure that the new information governance arrangements are effective, but also legally robust and compliant
  • Stakeholder engagement. This will include liaising with external legal advisors from partner organisations, government, suppliers as well as users

3+ years PQE, or relevant experience, in legal practice ideally in an in-house role and an understanding or awareness of statistics, data science and/or other aspects of data management, including information governance. Essential
Experience of working on legal issues around data protection, information governance or other data matters Desirable

Qualifications    
Qualified solicitor in Scotland with relevant degree and post graduate qualification Essential
An LLB from a UK university or equivalent law degree from another common-law jurisdiction Essential
